Advertiser Terms and Conditions

1. In these terms, (a) 'the Publisher' means Online Motorhomes & Caravans and onlinemotorhomes.com and onlinecaravans.co.uk respectively; (b) 'Buyer' means the person placing the order to insert the Advertisement, whether such person be the advertiser of the product/service (the 'Advertiser') or the Advertiser's advertising agency or media buyer; (c) an 'Advertisement' means the matter to be published or separately inserted.

2. The Buyer contracts with the Publisher as principal. Where the Buyer and the Advertiser are different persons, the Buyer warrants that it is properly authorised to place the Advertisement on behalf of the Advertiser.

3. The Buyer warrants that in relation to an Advertisement as submitted or subsequently amended:

(a)   the reproduction and/or publication of such Advertisement will not breach any legislation, regulation (governmental or otherwise) or contract or infringe or violate any copyright, trademark, or other personal or proprietary right of any person or render the Publisher liable to any proceedings whatsoever;

(b)   all advertising copy submitted to the Publisher is legal, decent, honest and truthful and complies with the British Code of Advertising Sales Promotion and Direct Marketing and all other relevant codes under the general supervision of the Advertising Standards Authority, OFCOM or any other applicable body; and

(c)   in relation to any financial promotion the Advertiser is, or the contents of the Advertisement have been approved by, an authorised person within the meaning of the Financial Services and Markets Act 2000 and related legislation including but not restricted to Financial Services and Markets 2000 (Financial Promotion) Order 2001 or that the Advertisement is otherwise permitted under that Act or related legislation.

4. The copyright for all purposes in all artwork, copy and other material which the Publisher or its employees have originated or reworked shall vest in the Publisher. The Buyer grants the Publisher a licence to reproduce in Onlinemotorhomes.com & onlinecaravans.co.uk all material not so vesting unless specifically agreed otherwise.

5. The Buyer agrees to check the correctness of the Advertisement. Any complaint, whether about the Advertisement (and of each individual Advertisement if part of a series) or the details contained in the invoice or email confirmation of booking (as the case may be), must be raised with the Publisher within 7 days of publication .

6. The Buyer will indemnify the Publisher and keep it indemnified against all claims, costs, proceedings, demands, losses, damages, expenses or liability whatsoever incurred by the Publisher arising directly or reasonably foreseeably as a result of any breach or non-performance by the Buyer of any of the representations, warranties or other terms herein contained or implied by law.

7. All material contained at Onlinemotorhomes.com & onlinecaravans.co.uk is published in good faith, the Publisher does not in any circumstances accept responsibility for the accuracy or otherwise of any Advertisement or message published or its compliance with any legal or regulatory requirements (nor is any kind of warranty expressed or implied by such publication). The Publisher specifically disclaims all and any liability to the Buyer, Advertisers, readers and users of any kind (other than death or personal injury caused by the Publisher's negligence or breach of statutory duty) for loss or damage of any nature whatsoever and however arising, whether due to inaccuracy, error, omission or any other cause, and whether on the part of the Publisher or its employees or agents or any other person. Save in the case of death or personal injury caused by the Publisher's negligence or breach of statutory duty, under no circumstances shall the Publisher be liable to the Buyer or the Advertiser or any other party for any special, incidental, indirect or consequential damages of any kind, including, without limitation, those resulting from loss of sales, loss of goodwill, loss of profits, whether or not the Publisher was advised of the possibility of such losses. In all other respects, the Publisher's liability shall be limited to either (a) placement of a new Advertisement the same of similar to the Advertisement originally booked.

8. The Buyer agrees that the Publisher has no liability in respect of any box numbers and agrees not to use box numbers for sending original documents, goods or payments of any kind, nor for the distribution of circulars. Box number replies will be collected only by the Buyer or the Buyer's nominee. An additional fee will be charged to the Buyer for use of a box number.

9. Advertisements are accepted on the understanding that they comply with the Business Advertisements (Disclosure) Order 1977 which requires all advertisements placed by the buyer who seek to sell goods, in the course of a Business, to make that fact clear in the wording of their advertisements.

10. If we believe and/or are advised that your advert is fraudulent we have the right to remove it with no prior warning and no refund will be offered to the buyer.

11. We shall have neither liability nor responsibility to any person or organisation with respect to any loss or damage arising from information or the use of information contained in this site or arising in connection with any related activity.

12. Avoid scams and fraud by dealing locally with the seller! Beware any deal involving Western Union, Moneygram, wire transfer, cashier check, money order, shipping, escrow, or any promise of transaction protection/certification/guarantee

13. You are advised that content may include technical inaccuracies or typographical errors.

14. We give no warranty and make no representation, express or implied, as to: the truth of any information given on onlinemotorhomes.com and onlinecaravans.co.uk by any Associate or third party; any implied warranty or condition as to merchantability or fitness for a particular purpose; compliance with any law; non-infringement of any right.

15. We or our content suppliers may make improvements or changes to onlinemotorhomes.com and onlinecaravans.co.uk, the content, or to any of the products and services described on onlinemotorhomes.com and onlinecaravans.co.uk, at any time and without notice to you.

We are under no obligation to monitor, vet, check or approve any such material. We disclaim all responsibility for information published on Onlinemotorhomes.com and onlinecaravans.co.uk by any person.

17. In no event shall we or our content suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, loss of data or loss of revenues or profits, whether in an action of contract, negligence or otherwise, arising out of or in connection with the use of Onlinemotorhomes.com and onlinecaravans.co.uk or the content available from Onlinemotorhomes.com and onlinecaravans.co.uk

18. Neither party shall be liable for any breach of its obligations resulting from causes beyond its reasonable control including acts of God, fire, natural disaster, war or military hostilities and strikes of its own employees.

19. Title, ownership rights, and intellectual property rights in the Content provided by us shall remain our sole property. We will strongly protect its rights in all countries.

20. You may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content, in whole or in part, except as is expressly permitted in this agreement or with our written authorisation.

21. You will not use or allow anyone else to use Onlinemotorhomes.com or onlinecaravans.co.uk to Post any Items or other materials that:
are false, inaccurate or misleading
are fraudulent or involves the sale of counterfeit or stolen items
infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy
violate the law of any established jurisdiction;
are defamatory, libelous, unlawfully threatening or unlawfully harassing
violate the legal rights of others
embarrass or cause distress or discomfort upon another user
are obscene or contain child pornography
contain viruses, Trojan horses, worms, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information
create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers
is unlicensed software;
is software which assists in or promotes: emulators, freaking, hacking, password cracking, IP spoofing;
promote discrimination or animosity to any person on grounds of gender, race or colour.

22.You will not use the Services for spamming. Spamming includes, but is not limited to:
The bulk sending of unsolicited messages, or the sending of unsolicited emails which provoke complaints from recipients;
Sending messages that promote alternative advertising services;
Excessive and repeated posting off-topic messages to the forums;
Excessive and repeated cross-posting;
Harassment of another User, including but not limited to, transmitting any threatening, libelous or obscene material, or material of any nature which could be deemed to be offensive;
The emailing of age inappropriate communications or content to anyone under the age of 18;
The use of any robot, spider or other automated device or manual process to collect email addresses or other personal information.
Any other action that restricts or inhibits other Users from enjoying onlinemotorhomes.com or onlinecaravans.co.uk.
